FERC Enhances Reliability Standards for Monitoring Electric Grid Cyber Systems
On January 19th, the FERC approved rules to improve the cybersecurity of the grid by issuing several directives to the North American Electric Reliability Corporation (NERC). Under the new rules, the NERC is required to develop and submit reliability standards for FERC approval that would require internal network security monitoring (INSM) for both medium-impact systems with high-speed internet connections and high-impact bulk electric system (BES) cyber systems with external routable connectivity.

FERC Proposes Updates to Oil Pipeline Affiliate-Only Committed Service Policy
The FERC has proposed to update its policy for evaluating whether an affiliate-only committed service on an oil pipeline is just, reasonable, and not unduly discriminatory. The FERC is reviewing the manner in which it analyzes whether a contractually committed transportation service for an oil pipeline is in compliance with the Interstate Commerce Act (ICA) when the only shipper to obtain the service is the oil pipeline’s affiliate.

President Biden Appoints Willie Phillips as FERC Acting Chairman
On January 3rd, the Federal Energy Regulatory Commission (FERC) announced that President Biden has named Willie L. Phillips FERC Acting Chairman. Mr. Phillips joined the FERC in December 2021 after practicing regulatory law for nearly 20 years in both the public and private sectors. Mr. Phillips also has a comprehensive background in the areas of public utility regulation, bulk power system reliability, and corporate governance.

FERC Anticipates Enhancements to Grid Reliability with Proposed IBR Standards
On November 17th, the Federal Energy Regulatory Commission (FERC) took a number of actions that focused on inverter-based resources (IBRs). The measures included orders proposing that new technologies and standards be created to improve and protect the reliability of the bulk power system and strengthen grid reliability, the Commission’s main endeavors.

FERC Publishes Updates to eForms Refresh
On November 21, 2022, the eForms system was revised to include the draft FERC Version 2023 taxonomies, validation rules, and rendering files effective for the filing of first quarter 2023 forms and all future filings. The Taxonomy Package is now available for download from the eForms portal under Taxonomy History. Additionally, the eForms system is currently accepting test submissions.

On November 17th, the FERC released its 16th annual report on its enforcement activities, which offers a comprehensive overview of the agency’s accomplishments in 2022 as part of its efforts to ensure that all energy markets are efficient, safe, reliable, and secure. The report includes the FERC’s significant actions, as well as its strategic goals and its guidance to the industry. The report also serves an important function in providing the public and the regulated community with more information regarding the FERC’s Office of Enforcement’s non-public activities.
